Compliance requirements
The bidder and its management body members must confirm that no exclusion grounds apply, including participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD. If an exclusion ground exists, the bidder may, where permitted, submit evidence of self-cleaning measures. The exact exclusion grounds and any possible self-cleaning conditions must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment or in an equivalent register to the Estonian commercial register. To provide the service, the bidder must have a travel operator activity notice or an equivalent registration in its home country. The bidder must have IATA membership or an equivalent status and a valid certificate; a copy of the certificate must be included in the tender. The bidder’s total annual turnover from all business activities in each of the last three completed financial years must be at least EUR 360,000 per year. To perform the contract, at least three travel consultants who speak Estonian must be involved: two of them must have at least 24 months of continuous experience as business travel consultants and a completed IATA course with a copy of the IATA diploma; one must have at least 36 months of continuous experience as a business travel consultant. The bidder must confirm compliance with the tender documents, submit Form I, where applicable Form II for a joint tender power of attorney, and Form III with the travel consultants’ details and copies of the IATA diplomas. The bidder must also confirm that it has the intellectual property rights needed to perform the contract, that the tender is not conditional, and that the offered goods are not subject to international sanctions. The bidder must have a guarantee under Section 15 of the Tourism Act to fulfil its obligations. The exact compliance and form requirements must be checked in the tender documents.
