Compliance requirements
The bidder must be excluded if the bidder, or a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, financing of terrorism, enabling illegal employment, illegal use of child labour, or human trafficking. Exclusion also applies where the bidder has tax, fee or environmental charge arrears, or arrears of tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder that has materially or repeatedly breached a previous public contract, or has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in public procurement cases, the reference numbers. Upon request, the contracting authority must be provided with evidence of proper performance. When submitting the tender, the bidder must confirm that the tender complies with the procurement documents, submit the tender price in the required table, and complete all unit price fields. The bidder must have a worker with valid switching authorisations for 0.22–20 kV electricity networks, where necessary with both low-voltage and medium-voltage switching rights, and that person must be entered in the Elektrilevi partner portal before opening of tenders. The bidder must also have a person designated as responsible for operating tasks with valid rights, entered in the EPP environment before opening of tenders. The bidder must have a lead person for electrical works with valid A-competence or at least level 6 qualification under the Vocational Education Act, with the relevant certificate at the time of tender submission and entered in the EPP environment before opening of tenders. The signatory of the contract and the contact person must be named together with their job titles and contact details; if the authority to represent does not arise from the articles of association, a power of attorney must be included. The bidder must also confirm that the materials, equipment and goods, including components, to be installed and used during the works are not produced in or originating from the Russian Federation or the Republic of Belarus, and the contracting authority may request certificates of origin. The machine-readable notice did not include precise additional requirements; these must be checked in the tender documents.
