Compliance requirements

The bidder must be excluded if any mandatory exclusion ground applies to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder: participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or financing of terrorism; enabling the employment of a foreign national staying in the country illegally or violating the conditions for employing a foreign national; illegal use of child labour or trafficking in human beings; or tax, fee or environmental charge arrears. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, or that has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, the client representative’s contact details and, in the case of public procurements, the reference numbers; the contracting authority may also request evidence of proper performance. The tender must include a price table in the format required by the procurement documents, and all unit price fields must be completed. The team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the opening of tenders; for low-voltage works at least MV switching authorisations are sufficient, while in other cases both MV and HV switching authorisations are required. There must also be a person appointed as responsible for work operations, entered into the Elektrilevi partner portal before the deadline for submitting tenders. The team must also include a leading electrical works person with valid A-competence or at least level 6 qualification under the Occupational Qualifications Act, with the relevant proof available at the time of submission; this person must also be added to the Elektrilevi partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must comply with all procurement document requirements, and conditional tenders are not allowed. If the bidder wishes to mark information as business secret, it must briefly describe and justify it; the tender price and other numerical indicators related to award criteria may not be marked as business secret. If the bidder is not submitting a joint tender, the joint bidder power of attorney question must be answered negatively.
