Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply: criminal offences related to participation in a criminal organisation, corruption, fraud, terrorist offences or financing of terrorism; unlawful employment of a foreign national or breach of conditions for employing a foreign national in Estonia, including payment below the statutory wage level; offences related to illegal use of child labour or human trafficking; tax, environmental charge, social security or similar debts in the bidder’s home country; or a situation where awarding the contract would breach an international or Government of the Republic sanction. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment if this is required by that country’s law, and must provide evidence of registration unless it is an Estonian company. Within the last 36 months before the start of the procurement, the bidder or its subcontractor must have performed at least one contract for a similar service, namely an engineering geological and/or geotechnical investigation. A list of the main contracts must be submitted, including the contract name, short description, performance period and the other contracting party. The person responsible for the works must have at least the professional qualification of Chartered Civil Engineer, level 7, with specialisation in geotechnics and elective competence in engineering geological investigations. Copies of documents proving that person’s qualification and competence must be submitted. Laboratory tests of soil and other samples taken during the investigation must be carried out in an accredited laboratory using accredited test methods and relevant standards, and the bidder or its subcontractor must hold a valid accreditation at the time of submitting the tender. If the bidder relies on a subcontractor, that subcontractor must also be listed in the register. The machine-readable notice did not include any more precise qualification or suitability requirements; these must be checked in the tender documents.
