Compliance requirements
The bidder is subject to the usual exclusion grounds, including participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, and other grounds laid down in the Public Procurement Act. Where an exclusion ground applies, the bidder may in some cases submit evidence of self-cleaning if this is permitted.
The bid must confirm that the bidder is not in such a situation and that it will not use subcontractors or suppliers linked to sanctions for more than 10% of the contract value. In particular, it must be confirmed that no subcontractors or suppliers who are Russian citizens, residents or entities established in the Russian Federation, or persons or entities controlled by them or acting on their instructions, will be involved. It must also be confirmed that no subcontractor will be used in performance of the contract if that subcontractor would be subject to replacement under Section 122(7) of the Public Procurement Act.

Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register. If the bidder is not established in Estonia, it must provide a valid registration certificate or equivalent proof confirming registration in the commercial register of its country of establishment.
The bidder’s average net turnover from construction works over the last three completed financial years must be at least EUR 10,000,000. If the bidder is not an Estonian company, it must submit extracts from its 2023–2025 annual accounts showing the relevant turnover. If the bidder belongs to a group, consolidated turnover figures are not accepted unless the bidder is the parent company of the group or the parent company provides a signed confirmation that the bidder is entitled to use the group’s resources for performance of the contract. The exact wording of the scope of that confirmation was not fully visible in the machine-readable notice, so the tender documents should be checked if needed.
The bid must also confirm compliance with the conditions set out in the tender documents, including the submission of a power of attorney in the case of a joint bid and any required forms and evidence. The machine-readable notice did not include all precise qualification or compliance requirements; these must be checked in the tender documents.
