Compliance requirements
The ESPD includes the standard mandatory exclusion grounds, including participation in a criminal organisation and corruption. If such a ground applies, the bidder may, where allowed, provide evidence of self-cleaning. The machine-readable notice does not provide the full list of exclusion grounds, so the official tender documents must be checked for the complete requirements.
Qualification criteria and exclusion grounds
The bidder must have experience in selling the products offered in this tender. Over the last 3 years before the publication of the contract notice, the bidder must have sold each product offered in this tender in a quantity of at least one third of the planned quantity stated in Annex 1 for the framework agreement period. The bidder must submit a list of properly completed sales contracts/transactions showing, for each relevant lot and product, the exact product name, contract dates, value and the other contracting party, and indicating numerically how many units were sold under each contract. The bidder must also confirm this in the ESPD.
The bidder must have a product representative working in the company or under another contractual arrangement who has been trained by the manufacturer or has completed training for the products covered by the tender. On request, the bidder must provide copies of certificates for the completed training or a written confirmation from the manufacturer that the person has been trained for the offered products.
The bidder must have the right to sell the offered products in Estonia. The bidder must submit a document, or a copy of it, proving the sales authorisation granted by the manufacturer or, if the manufacturer is not established in the European Union, by the manufacturer’s authorised representative. If sub-authorisation has been granted, the corresponding documents confirming the sub-authorisation must also be provided.
