Compliance requirements
The contracting authority will exclude a bidder or applicant if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply: convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to enabling illegal employment of a foreign national or violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or social security contribution arrears under the law of the bidder’s country of establishment; or a situation where awarding the contract would breach an international sanction or a sanction of the Government of the Republic.
The bidder must confirm that no exclusion grounds apply. A foreign bidder must provide evidence of the absence of exclusion grounds: a criminal record extract or equivalent document from the country of establishment for points 1–3, and a certificate from the competent authority of the country of establishment for point 4.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment if that is required by the law of that country, and must provide a copy of the relevant registration evidence if the obligation applies. An Estonian bidder does not need to submit a register extract.
To prove technical and professional capability, the bidder must show that during the 7 years before the start of the procurement it has itself properly performed at least one similar study, analysis or engineering work with a total value of at least EUR 70,000. A similar assignment means work that resulted in a conceptual technical solution for the reconstruction or modernisation of a boiler or steam generator of a coal-fired power plant, combined heat and power plant, or other industrial steam production unit with an electrical or thermal rated capacity of at least 200 MW.
The reference work must include at least three of the following activities: thermal and process engineering calculations for the boiler or steam system; analysis of boiler operating modes and load ranges; analysis of boiler-turbine interaction for steam production; assessment of the technical feasibility of using different fuel types or fuel mixtures; conceptual development and comparative assessment of reconstruction options; preparation of investment and reconstruction cost estimates. The result must be a feasibility study, concept design, preliminary design or other equivalent engineering analysis. The bidder’s role, responsibilities and participation must be clearly visible from the reference.
The bidder must submit a list of the most important similar contracts on the contracting authority’s Form 1 or an equivalent form, including the contract value, dates and the other contracting parties.
