Compliance requirements
Mandatory exclusion grounds include conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; conviction for enabling the illegal employment of a foreign national or for violating wage requirements; conviction for illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of the country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous contract, or that has submitted false information about qualification conditions or failed to provide the requested data and supporting documents. The bidder must confirm that none of these grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties (the client representative’s contact details, including phone number and email address), and, in public procurements, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bidder must also provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included in the tender. The bidder must submit the cost table in the form required by the tender documents, with all unit price fields completed. The team must include a person with valid switching rights for switching operations in the 0.22–20 kV electricity network, entered in Elektrilevi’s partner portal before the tender submission deadline; for low-voltage works only, at least low-voltage switching rights are required, and in other cases both low-voltage and medium-voltage switching rights are required. The team must also include a person responsible for the work operation, entered in the partner portal before the deadline. In addition, the team must include a person managing electrical works who has valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, has the relevant certificate at the time of submission, and is entered in the partner portal before the deadline. The bidder must confirm compliance with the tender documents and submit any required confirmations, forms and documents.
