Compliance requirements
The contracting authority will exclude a bidder if mandatory exclusion grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreign nationals or breach of conditions for employing foreign nationals in Estonia; offences related to illegal use of child labour or human trafficking; or tax, duty or environmental charge arrears, or social security contribution arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached an earlier public contract so that the contract was terminated, rescinded, price reduced, damages paid or a contractual penalty paid, or if it has submitted false information about compliance with qualification requirements or failed to submit requested additional documents. The bidder must confirm that none of these mandatory or voluntary exclusion grounds apply.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting party’s details, including the client representative’s contact details, telephone number and email address, and, in the case of public procurement, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the authority can obtain the information from public or its own databases without significant cost. The bid must include the completed price table. For submission of the bid, the bidder must have a person in charge of electrical works with a valid A-level competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, with the relevant certificate and entered into the EPP environment before bid opening. The bidder must also have a worker with switching rights for 0.22–20 kV network work, and where necessary both low-voltage and medium-voltage switching rights. In addition, there must be a person appointed as responsible for the work operation, entered into the EPP environment before bid opening. The bidder must provide the names and contact details of the contract signatory and the contact person, and, if representation rights do not arise from the articles of association, a power of attorney must be included.
