Compliance requirements

The bidder must confirm that neither it nor the members of its administrative, management or supervisory bodies, nor its authorised representatives, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. Qualification criteria and exclusion grounds

According to the ESPD and the compliance conditions, the bidder must confirm that the bid complies with all conditions set out in the tender documents. Conditional bids are not allowed. The bidder must also confirm compliance with the EU Council sanctions requirement: subcontractors and suppliers accounting for more than 10% of the contract value may not be Russian citizens, residents or Russian-established undertakings, entities more than 50% owned by them, or persons acting on their behalf or under their instructions. In a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must indicate any trade secrets in the bid and justify that designation. It must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. If equivalence is relied on, supporting evidence must be provided.
