Compliance requirements
The bidder and its management bodies must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other offences listed in the ESPD, where the exclusion ground applies. If such a ground exists, the bidder may submit evidence of self-cleaning measures to restore reliability. The ESPD may also require confirmation of tax and social security payment and declarations related to sanctions and other exclusion-related matters.
Qualification criteria and exclusion grounds
The bidder must submit an offer that complies with all conditions set out in the procurement documents and the technical specification. Conditional offers are not allowed. If requested by the contracting authority, at least 5 products in original packaging must be submitted as samples within 5 working days after notification. The samples must be sufficient for checking technical compliance and practical testing; non-compliance or late submission may lead to rejection of the offer. The team must include at least one medical technology specialist who has received manufacturer training for maintenance and repair of the offered device, and the manufacturer’s confirmation of such training must be provided. The offer must also include manufacturer documentation, including the declaration of conformity, product catalogues, user and maintenance manuals and other technical documents proving compliance. In the case of a joint tender, a power of attorney from the joint tenderers must be submitted. The bidder must also provide the required contact person details and confirm that the offered goods are not subject to international sanctions and that subcontractors or suppliers linked to the Russian Federation will not account for more than 10% of the contract value.
