Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1) points 1–5 of the Estonian Public Procurement Act apply. These include convictions for organised crime, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or breach of employment conditions for foreigners; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where awarding the contract would breach an international sanction or a sanction of the Government of the Republic of Estonia.

Qualification criteria and exclusion grounds

The bidder and/or its subcontractor must have a qualified responsible person for the works to be performed under the contract. The required person is an electrical works supervisor with a professional certificate of ‘Electrical Engineer, level 7 at least’ or equivalent A-class competence, or better. The bidder must submit copies of documents proving that person’s qualification and competence. A foreign bidder without documents issued in Estonia must submit copies of equivalent documents issued under the laws of its country of establishment and a confirmation that, within one month after signing the contract, it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned person’s qualification and competence. The bid must be submitted in the structure set out in the procurement documents, conditional bids are not allowed, and in a joint bid a joint representative must be appointed and a joint bidder authorisation must be attached. The bidder must also submit the expected delivery and work schedule in weeks from contract signature and a short description or product sheet of the offered vacuum switchgear set.
