Compliance requirements

The contracting authority will exclude a bidder if any exclusion ground under § 95(1) points 1–5 of the Public Procurement Act applies, and may also exclude a bidder if any ground under § 95(4) points 2–12 applies. The bidder must confirm in the public procurement register that none of these grounds apply. A foreign bidder must also provide a criminal record certificate or an equivalent document, and a certificate from the competent authority where required. It must also be confirmed that the company is not restricted by any residence- or establishment-based participation restriction and that subcontractors or suppliers linked to the Russian Federation and subject to sanctions will not be engaged for more than 10% of the contract value. Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 800,000. In the 36 months before the start of the procurement, the bidder must have completed at least 2 outdoor cleaning service contracts, each with a value of at least EUR 600,000 excluding VAT. The bidder must provide the contract details, including value, signing date and information about the other contracting party. The contractor must have a contact person who performs the duties of a foreman, is available to the client by phone 24/7, replies to emails within 2 hours, has at least B2-level Estonian language skills, and has worked as a foreman for at least 12 consecutive months within the last three years on a site with an outdoor maintenance area exceeding 50,000 m². The bid must also include a list of the equipment to be used, a description of the work organisation, and a description of how service continuity will be ensured. The bid must comply with the tender documents; conditional bids are not allowed; the bid price must be submitted in the required structure; and bids with zero or negative values are not accepted. Where relevant, an equivalence explanation and supporting evidence must be provided, as well as a business secrecy marking with justification and, in the case of a joint bid, a power of attorney.
