Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–5 of the Estonian Public Procurement Act apply to it. These grounds cover, in plain language, convictions for corruption, fraud, participation in a criminal organisation, terrorism-related offences, money laundering or terrorist financing; violations related to employing foreigners without the right to work or under unlawful working conditions; child labour or human trafficking; tax, fee or social security contribution debts; and situations where the contract would breach an international or Government of Estonia sanction.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment if this is required by that country’s law, and must provide proof of registration where applicable. The bidder or its subcontractor must have completed at least 1 similar contract within the last 36 months before the start of the procurement: design of an industrial technological object or system for the supply of solid bulk materials at the preliminary design, basic design or detailed design stage. In addition, the bidder or its subcontractor must have a responsible specialist for the technological part and automation part who has performed such duties under at least one contract during the last 36 months. The bidder must also have a responsible specialist for the construction part with at least the professional qualification of Chartered Civil Engineer, level 7, specialization in Building Construction, or equivalent, and a responsible specialist for the electrical part with at least the professional qualification of Chartered Electrical Engineer, level 7, specialization in Electrical Networks and Systems with design rights, or at least an A-class competence certificate with design rights, or equivalent. The bidder must submit Form 2, the list of contracts, Form 3, the list of responsible specialists, and copies of documents proving competence. A foreign bidder that does not have the qualification and competence documents issued in Estonia must submit equivalent documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
