Compliance requirements

The contracting authority will exclude a bidder if any mandatory exclusion ground applies to the bidder or to a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, including convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of a foreign national staying in the country without legal basis, unlawful enabling of employment conditions for a foreign national in Estonia, or illegal use of child labour or human trafficking. Exclusion also applies if the bidder has tax, duty or environmental charge arrears, or arrears of tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract, or if the bidder has submitted false information about compliance with qualification requirements or failed to submit required additional documents.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party (including the client representative’s contact details, telephone number and email address), and, in the case of public procurement, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed. The bid must also comply with the tender documents, include the price table in the required form, and name the required personnel: a switching-authorised employee for 0.22–20 kV switching operations, a person responsible for the work operation, and a leading electrical works person with valid A competence and/or at least level 6 qualification under the Vocational Education Act, all entered in Elektrilevi’s partner portal before the bid deadline. The bidder must also provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if representation rights do not arise from the articles of association, a power of attorney must be included. If the bidder does not join the contracting authority’s standard payment term, the contract payment term is 95 calendar days under the factoring programme. The bidder must confirm that the bid is unconditional, that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus, and that the bidder’s place of residence or establishment is not in those countries. If the machine-readable notice does not contain precise requirements, they must be checked in the tender documents.
