Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) points 1–5 of the Estonian Public Procurement Act apply. These include convictions for organised crime, corruption, fraud, terrorism-related offences, illegal employment of foreigners, child labour or human trafficking, tax or social security debts, and situations where awarding the contract would breach an international or Government of Estonia sanction. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. A foreign bidder must submit a copy of a valid registration certificate; for bidders registered in Estonia, the contracting authority checks the data itself. The bidder or its subcontractor must have completed at least one contract similar to the subject matter of the procurement within the 36 months before the start of the procurement, related to the installation or upgrading of security systems. The bidder must submit the list of contracts on Form 2 with dates and the other contracting parties, and confirm that the contracts were performed properly. The persons responsible for carrying out the work must include at least a security systems technician with a level 4 professional certificate in security systems technology, or equivalent, and a person managing electrical work with at least a class B competence certificate, or equivalent. The bidder must submit Form 3, a list of responsible persons, and copies of documents proving their qualifications and competence. If a foreign bidder or its foreign subcontractor does not have the relevant documents issued in Estonia, it must submit copies of the documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority. The tender must comply with the procurement documents, and alternative, conditional or partial tenders are not allowed. The bid price must be submitted on Form 1 and in the structure set out in the worksheet "Award criteria and evaluated indicators". The bidder must also submit documents confirming the type of the offered equipment, a list of technical characteristics, or the equipment passport. If the tender documents require any other evidence, forms or confirmations, they must be submitted with the tender.
