Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, nor other legal representatives, are subject to the exclusion grounds listed in the Public Procurement Act § 95(1) points 1, 4 and 5, § 95(4) points 3 or 4, and § 177(2). In practical terms, the company must not be linked to convictions for participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing, or other statutory exclusion grounds. In addition, the bidder must confirm that subcontractors or suppliers linked to the Russian Federation will not be involved for more than 10% of the contract value, and that no subcontractor will be used if it would have to be replaced under § 122(7).
Qualification criteria and exclusion grounds
For the low-voltage works, the bidder must have, through the chief designer, the low-voltage work bidder, a joint bidder or a subcontractor, a state secret processing permit issued by the Estonian Internal Security Service at CONFIDENTIAL level or higher and a compliance certificate for the processing system issued by the Estonian Foreign Intelligence Service at CONFIDENTIAL level or higher. If the permit or certificate expires during the procedure or contract term, a new application must be submitted so that access does not lapse.
The bidder must involve responsible persons with valid professional certificates in at least the following roles: chief project manager, site manager, electrical works supervisor, district heating works supervisor, district heating design responsible person, automation works responsible person, and low-voltage design responsible person. The required qualifications include, among others, construction engineer level 7 or 6, Class A competence certificate or electrical engineer level 7, thermal energy engineer level 6 or 7, certified automation engineer level 7, and security systems designer level 6 with competencies in alarm system design, surveillance system design and fire alarm system design.
The bidder may rely on the specialist of another person, including a subcontractor, but one and the same person must be submitted for each role. If the bidder relies on another person’s resources, it must provide that person’s written and signed consent and confirmation that the person will participate directly in performing the contract. The bidder must also provide the details of the responsible persons and the validity information of the state secret access permits in RHAD Annex 1 Form II.
As for similar works, during the last 60 months the bidder must have carried out, on at least one site, external electrical network construction works including installation of generator sets with a rated power of at least 1000 kVA, and district heating construction works including installation of underground pipelines with a diameter of 125–250 mm over at least 500 linear metres and installation of tuned heating substations with a capacity of at least 130N. Evidence from the client or its representative must be provided confirming that the works were performed in the required scope and properly.
The bid must comply with the tender documents, be unconditional, and the price must be submitted according to the required structure. If equivalence is relied upon, it must be explained and supporting evidence must be attached. In the case of a joint bid, a power of attorney for the joint bidders must be submitted.
