Compliance requirements

The contracting authority will exclude a candidate and will not award the contract if the candidate or certain related persons have the exclusion grounds listed in the Public Procurement Act, including the grounds referred to in section 95(1)(1), (4) and (5), section 95(4)(3) or (4), and section 177(2)(1) and (2). The candidate must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must provide a state secret processing permit and a systems accreditation compliance certificate for low-voltage works if it relies on the relevant personnel or subcontractors. The permit must be issued by the Estonian Internal Security Service at the CONFIDENTIAL level or higher, and the compliance certificate must be issued by the Foreign Intelligence Service at the CONFIDENTIAL level or higher. If the permit or certificate expires during the procedure or contract period, a new application must be submitted in time so that access does not lapse. The bidder must involve responsible persons with valid professional certificates in at least the following roles: chief project manager, site manager, electrical works supervisor, district heating works supervisor, district heating design responsible person, automation works responsible person, and low-voltage design responsible person. The chief project manager must be a civil engineer level 7 or higher, specialised in building construction and competent in construction management or management of construction activities. The site manager must be a civil engineer level 6 or higher with the same specialisation and competence. The electrical works supervisor must hold either an A-class competence certificate or be an electrical engineer level 7. The district heating works supervisor must be a district heating engineer level 6. The district heating design responsible person must be a district heating engineer level 7. The automation works responsible person must be a certified automation engineer level 7. The low-voltage design responsible person must be a security systems designer level 6 with competencies in alarm system design, surveillance system design and fire alarm system design, and must hold a state secret access permit at the CONFIDENTIAL level or higher by the time the contract is signed. The bidder may rely on another person’s specialist, including a subcontractor’s specialist, but one and the same person must be proposed for each role. If the bidder relies on another person’s resources, it must submit that person’s written and signed consent and a confirmation that no exclusion grounds apply. The bidder must also provide the details of the responsible persons and the validity information of the state secret access permits. In addition, the bidder must prove similar works performed during the last 60 months: at least one project involving external electrical networks with installation of generator sets with a rated power of at least 1000 kVA, and at least one project involving district heating works with installation of underground pipelines with a diameter of at least 125–250 mm over at least 500 linear metres and installation of adjusted heating substations with a capacity of at least 130N. For these works, a confirmation from the client or its representative must be provided showing that the works were performed in the required scope and properly. If the bidder relies on another person’s indicators, that person’s written and signed consent must also be submitted.
