The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply. These include, among other things, convictions for organised crime or corruption, enabling work by a foreign national staying in the country unlawfully or violating employment conditions, illegal use of child labour or human trafficking, tax or social security debt, and breach of sanctions. The exact check must be made against the tender documents and the bidder must provide the relevant confirmation.

The bidder must be entered in the commercial register of its country of establishment if this is required by the law of that country. If registration is required, an appropriate proof of registration must be submitted; an Estonian bidder does not need to submit a register extract. As compliance conditions, the bid must confirm that it complies with the procurement documents, that equivalence has been explained where necessary and supporting evidence has been attached. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also submit the bid price in the required structure and complete Form 1, the bid form. If the bid contains trade secrets, they must be briefly described and justified; the bid price and other price-related numerical indicators may not be marked as trade secrets.
