Compliance requirements

Mandatory exclusion grounds: the bidder must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment of a foreign national, illegal use of child labour, or human trafficking-related offences. The bidder must also not have outstanding state tax, fee, environmental charge or social security contribution debts. The bidder must confirm that none of these grounds apply. Voluntary exclusion grounds: the contracting authority may exclude a bidder that has previously seriously or repeatedly breached essential contract terms, or that has provided false information about compliance with qualification requirements or failed to submit required data/documents. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have been worth at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details, phone number and email address) and, in public procurement cases, the reference numbers, if available. The contracting authority may request evidence of proper performance. The bid must comply with all tender document requirements and include the price table with all unit prices completed. The team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the bid submission deadline; for low-voltage works at least low-voltage switching authorisations are required, and in other cases both low-voltage and medium-voltage switching authorisations are required. There must also be a person designated as responsible for the work operation, entered into the Elektrilevi partner portal before the deadline. The bidder’s team must also include a lead electrical works person with valid A-competence or at least level 6 qualification under the Occupational Qualifications Act, with the relevant proof available at the time of bid submission; this person must also be added to the Elektrilevi partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory(ies) and the contact person, and a power of attorney if required. In a joint bid, a joint bidders’ power of attorney must be attached. The bidder must indicate any trade secrets in the bid, but may not mark the bid price or other numerical indicators that relate to award criteria as trade secrets. Materials, equipment and goods used in the works may not be produced in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin. The machine-readable notice did not include precise requirements; these must be checked in the tender documents.
