Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or any other exclusion ground listed in the ESPD. The bidder must also confirm payment of taxes and social security contributions and, where relevant, that it is not insolvent, in liquidation, with business activities suspended or in an arrangement with creditors. The bidder must also provide confirmations regarding international sanctions, subcontractors and the other exclusion grounds asked for in the ESPD. If an exclusion ground applies, the bidder may in some cases provide evidence of self-cleaning or restored reliability, where this is permitted.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents. The selected documents do show that the bid must comply with the procurement documents and that conditional bids are not allowed. Under the compliance requirements, the bidder must confirm that it will not involve subcontractors or suppliers representing more than 10% of the contract value if they are linked to a citizen, resident or company established in the Russian Federation or are controlled by such persons or entities. The bidder must also confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act. If equivalence is relied on, it must be explained and supporting evidence must be attached. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The machine-readable notice did not provide any exact figures for turnover, previous experience, team composition, certificates or other qualification requirements.
