Compliance requirements
The bidder must not be subject to mandatory exclusion grounds: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal work in Estonia or violating the conditions for a foreign national’s work; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or equivalent arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous contract or has submitted false information on qualification or failed to provide required documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of them worth at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party and public procurement reference numbers; on request, evidence of proper performance must also be provided. The bid must comply with all tender document requirements and include the required price table, with all unit prices completed. The bidder must have a worker with valid switching rights for switching operations in the 0.22–20 kV network and a person assigned as responsible for the work operation with valid rights; both must be entered in the EPP environment before the opening of bids. The bidder must also have a person managing electrical works with valid A-level competence or at least level 6 qualification under the Vocational Qualifications Act, who has the relevant certificate at the time of submission and is added to the EPP environment. In addition, the bidder must provide the names and contact details of the contract signatory and the contact person, and a power of attorney if needed. The bidder must confirm whether it chooses the contracting authority’s standard payment term and whether the bid contains trade secrets. Materials, equipment and goods used in the works may not be produced in or originate from the Russian Federation or the Republic of Belarus; the bidder’s place of establishment or residence may also not be in those countries.
