Compliance requirements
The bidder must confirm that it has reviewed all rules and instructions published on the contracting authority’s website.
The contracting authority will exclude a bidder or applicant if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply: convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing; unlawful employment of a foreign national or breach of conditions for employing a foreign national in Estonia, including payment of wages below the statutory wage rate; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of the bidder’s country of establishment; or a situation where awarding the contract would violate an international sanction or a Government of the Republic sanction under the International Sanctions Act.
The machine-readable notice did not include any more precise exclusion grounds; they must be checked in the tender documents.
