Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply. This means that neither the bidder nor the members of its management bodies may have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, human trafficking, or the other listed offences. The bidder must also have no outstanding state tax, fee or environmental charge debts, and no sanctions-related breach may apply. In addition, the bidder must confirm that it has reviewed the rules and instructions published on the contracting authority’s website.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority will check the data itself. If the bidder is not the manufacturer of the offered goods, it must submit a copy of the manufacturer’s authorisation allowing the drilling tools to be marketed in Estonia. The bidder must prove that it has the technical capability to supply the drilling tools described in the tender. To meet the compliance requirements, the bidder must submit the manufacturer’s technical specification with key parameters and technical data, the manufacturer’s drawings, the completed REV-1 form, samples of the drilling tools, and confirmation that the delivery time from the order letter is at most 30 calendar days. The packaging must be made of recyclable, renewable or reusable materials, and the bidder must confirm that it will use such packaging. By submitting the tender, the bidder must confirm that the tender complies with all conditions set out in the procurement documents.
