The bidder must confirm that it has reviewed all rules and instructions published on the contracting authority’s website. The contracting authority will exclude a bidder or applicant if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply: convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing; unlawful employment of a foreign national or breach of conditions for employing a foreign national in Estonia, including payment of wages below the statutory wage rate; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of the bidder’s country of establishment; or a situation where awarding the contract would violate an international sanction or a Government of the Republic sanction under the International Sanctions Act. The bidder must be registered in the commercial register or another similar register in its country of establishment, if this is required by the laws of that country. For a bidder registered in Estonia, the contracting authority will check the data itself. A foreign bidder must be registered in the commercial register or a similar register if its national law requires it. The bidder must have the technical capability to supply the drilling tools described in the tender. If the bidder is not the manufacturer of the offered drilling tools, it must submit a copy of the manufacturer’s authorisation to market the drilling tools in Estonia.
