The contracting authority checks the exclusion grounds of the successful tenderer before contract award. The tenderer must confirm that neither it nor any joint tenderer is subject to the exclusion grounds referred to in Section 95(1) of the Public Procurement Act. If needed, the tenderer must provide appropriate and justified evidence of self-cleaning measures in accordance with Section 97. The machine-readable notice did not include more precise exclusion grounds; they must be checked in the tender documents.

The tenderer must provide evidence or a website reference confirming the right to sell the licences and provide product support in Estonia. If the representation right is obtained through a cooperation partner, the tenderer must also provide both the manufacturer’s confirmation or website reference and the cooperation partner’s confirmation or website reference about the cooperation with the tenderer. The tenderer must describe the licence model offered: whether one licence is offered with the same activation key or multiple licences with different activation keys. The machine-readable notice did not include precise qualification or suitability criteria; they must be checked in the tender documents.
