Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply. A foreign bidder must also provide equivalent evidence from its country of establishment: a criminal record extract or equivalent document for the circumstances referred to in Section 95(1)(1)–(3), and a certificate from the competent authority for the circumstance referred to in Section 95(1)(4). The notice also mentions a domestic exclusion ground related to restrictions based on the bidder’s place of establishment; the bidder must answer the relevant confirmation questions in the tender documents.
