Compliance requirements
The contracting authority excludes a bidder if the bidder or its management/representation/control persons have been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing. Exclusion also applies if those persons have been convicted for enabling illegal employment of a foreign national staying in the country without legal basis, for violating the conditions of employment of a foreign national in Estonia, including paying less than the statutory wage rate, or for illegal use of child labour or human trafficking. The bidder is also excluded if it has tax, fee or environmental charge arrears, or tax/social security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract, or if the bidder has provided false information or failed to submit required information or additional documents concerning qualification. The machine-readable notice did not include any more precise exclusion details; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting party’s details (including the client representative’s contact details, phone number and email address), and, in public procurement cases, the reference numbers. On request, the contracting authority may require evidence that the contracts were properly performed, unless it can obtain the information from public or its own databases without major cost. In addition, the bidder’s team must include a person with valid A-competence or an electrical works manager with at least level 6 qualification under the Vocational Qualifications Act, who has the relevant proof at the time of tender submission and is entered in Elektrilevi’s partner portal before the tender submission deadline. The tender must comply with the tender documents and include the required price table. If this is a joint tender, a power of attorney from the joint bidders must be attached.
