Compliance requirements
The bidder must not be bankrupt or in liquidation, nor subject to bankruptcy or liquidation proceedings, nor have its business activity suspended, or be in a similar situation under the law of its country of establishment. The bidder must not have tax, duty, environmental charge, or social security contribution arrears, unless the debt has been deferred, paid, or is being paid/deferred within 10 calendar days after notice.
The bidder must also confirm that the exclusion grounds under section 95(1)(1–3 and 5) of the Public Procurement Act do not apply, taking into account section 95(2). If the contracting authority cannot verify the absence of these grounds from public registers, the bidder may be asked to submit supporting evidence issued no more than two weeks before the tender deadline.
The bidder and the technical consultant advising the beneficiary on apartment building reconstruction must not be related persons. If the bidder does not submit the required evidence and the absence of the grounds cannot be checked from public registers, the bidder may be given 10 calendar days to provide the documents; otherwise the bidder is excluded.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have a business activity notice for electrical works covering construction and installation of electrical installations. The registration requirement does not apply to a foreign bidder; in that case, equivalent proof of competence must be provided.
The bidder's net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value, excluding VAT. The exact amount must be entered in euros.
By submitting the tender, the bidder confirms that it can provide a performance security of 5% of the contract value by the contract date at the latest. The security must be valid throughout the construction period. A deposit to the beneficiary's bank account or notary account is also accepted if the beneficiary remains entitled throughout the construction period. Joint bidders may satisfy the security requirement together.
The bidder must have carried out at least one equivalent construction work within the 60 months before the start of the procurement procedure, with a value of at least half of the estimated contract value. Equivalent work means construction, extension, or full-building reconstruction as the main contractor, including at least structural and external envelope works, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide the name of the work, building details, the time and value of the work, whether it was construction, extension or full reconstruction as main contractor, and whether it included the required structural, ventilation and heating works.
For a full-building reconstruction, the bidder's team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, if electrical works are performed, a person with at least B-class competence certificate or an electrical engineer qualification at level 6 for consumer electrical installations. If the bidder relies on the capacities of another person, the signed commitment of that person must be attached.
