The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply to it. These grounds cover convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreign nationals or breach of employment conditions; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where awarding the contract would breach an international or Government sanction. The notice also requires the bidder to confirm this by answering yes/no.

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself. A foreign bidder must submit a copy of a valid registration certificate if its national law requires registration. The bidder and/or its subcontractor must have performed at least one similar contract related to pipeline insulation works within the 60 months before the start of the procurement. The bidder must submit Form 2, the list of contracts, with information on the contract dates and the other contracting parties. If the bidder relies on a subcontractor’s reference, the subcontractor must also be entered in the subcontractors table so that the contracting authority can check exclusion grounds.
