Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorism or other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning where this is allowed. The ESPD does, however, set out exclusion grounds for which the bidder must provide confirmations and, where necessary, evidence. The compliance conditions require confirmation of bid security, compliance with environmental requirements, a power of attorney for a joint bid, confirmation that the bid complies with the tender documents, confirmation of sanctions-related requirements, and confirmation that a workplace disputes and complaints procedure is in place.
