Compliance requirements
The bidder is excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, illegal employment of foreigners, unlawful employment conditions for foreigners, child labour offences or human trafficking. Exclusion also applies if the bidder has tax debts or social security contribution debts. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurements, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or its own databases. In addition, the team must include a person responsible for electrical work with valid A-competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, who has a relevant certificate at the time of bid submission and has been entered into the Elektrilevi partner portal before the bid deadline. The bid must also include the price table, the contract signatory and contact person details, and, where applicable, a power of attorney. The bid must comply with all tender documents and conditional bids are not allowed.
