Compliance requirements

The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other offences listed in the ESPD. If such a ground applies, the bidder may submit evidence of self-cleaning measures where this is allowed. The machine-readable notice did not fully show all exclusion grounds; the remaining grounds must be checked in the tender documents.

Qualification criteria and exclusion grounds

The machine-readable notice did not set out separate selection criteria such as turnover, previous experience or team composition in precise terms. As compliance requirements, the bidder must confirm that its offer meets all requirements set out in the tender documents. For each lot, the offer must include a technical description of the offered device and manufacturer documents showing compliance with the technical specifications. Delivery to the contracting authority’s address must be within 8 weeks. The warranty must last at least 24 months, and during the warranty period full maintenance must be carried out at the manufacturer’s prescribed frequency, but at least once during the warranty period. The bidder must have the manufacturer’s sales and service authorisation in Estonia, authorised manufacturer-backed technical support in Estonia with a 48-hour response time, and a service unit or an agreement with a service unit located in Estonia; the service engineer’s competence must be proven by a manufacturer-issued certificate or other document. In the case of a joint bid, an authorised representative must be appointed. The bid may not be conditional. The bid price must be submitted in the prescribed structure. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
