Compliance requirements
The bidder must be excluded if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence or other terrorism-related offence, money laundering or terrorist financing. Exclusion also applies where there is a conviction for enabling the employment of a foreign national staying in the country illegally, for unlawful use of child labour, or where the bidder has tax, fee, environmental charge or social security contribution debts under the law of the country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract so that the contract was withdrawn from, terminated, price-reduced, damages were paid or a contractual penalty was paid, or if the bidder has submitted false information about qualification or failed to submit required data and documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
During the 60 months before the start of the procurement, the bidder must have properly performed at least three electrical construction contracts similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without major cost. The tender must comply with the procurement documents and include a price table with all unit price fields completed. The bidder must have an employee with valid switching authorisations for work in the 0.22–20 kV electricity network; if only low-voltage works from 0.22–1 kV are procured, at least low-voltage switching authorisations are sufficient, otherwise both low- and medium-voltage switching authorisations are required. The bidder must also have a person responsible for the work operation with valid rights and an electrical works manager with valid A-competence or at least level 6 qualification and the relevant certificate at the time of submission. The signatory and the contact person for contract performance must be named together with their job titles and contact details; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must also confirm the standard payment term choice and provide a description of any business secret, or confirm that the tender contains no business secret. Materials, equipment and goods used in the works may not be produced in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
