Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; no conviction for illegal employment of a foreign national staying without legal basis or for violating the conditions of employing a foreign national in Estonia, including paying less than the statutory wage; and no conviction for illegal use of child labour or human trafficking. The bidder must also confirm that it has no tax, fee or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has provided false information or failed to submit required documents on qualification compliance.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, showing the performance period, the other contracting party’s contact details, and, for public contracts, the reference numbers. On request, evidence of proper performance must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bid must also include a completed price table. The bidder must have an electrical works manager with valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, with the relevant proof available at the time of submission and entered into the EPP environment before bid opening. For switching operations in the 0.22–20 kV network, the bidder must have a person with valid switching rights entered into the EPP environment before bid opening; for low-voltage works only, at least low-voltage switching rights are required, otherwise both low-voltage and medium-voltage switching rights are required. The bidder must also have a person responsible for the work operation entered into the EPP environment before bid opening. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if authority does not arise from the articles of association, a power of attorney must be included. The bidder must state whether the bid contains business secrets and justify that designation, or confirm that it does not. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that materials, equipment and goods used in the works, including components, are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin.
