Compliance requirements
Mandatory exclusion grounds: the bidder must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, unlawful employment of foreign nationals, or human trafficking. The bidder must also have no tax, fee or environmental charge arrears, and no tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder that has previously seriously or repeatedly breached an important contract term, or that has submitted false information about qualification or failed to submit required information or documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting parties and, in public procurement cases, reference numbers. The contracting authority may request evidence that the similar electrical works contracts were properly performed.
The bid must comply with all tender document requirements and include a price table completed in the prescribed form. All unit price fields must be filled in.
The bidder’s team must include:
- a switching-authorised employee for 0.22–20 kV electrical networks; for low-voltage works, at least low-voltage switching authorisation is sufficient, while in other cases both low-voltage and medium-voltage switching authorisations are required;
- a person appointed as responsible for the work operation (C-person), who must be entered in Elektrilevi’s partner portal before the bid submission deadline;
- a leading electrical works specialist with valid A-competence or, within the meaning of the Vocational Education Institutions Act, at least level 6 qualification and the relevant proof as of the bid submission date; this person must also be entered in the Elektrilevi partner portal before the deadline.
The bidder must provide the names, job titles and contact details of the contract signatory(ies) and the contact person for contract performance matters. If the right of representation does not arise from the articles of association, a power of attorney must be included.
If the bid is submitted jointly, a joint bidders’ power of attorney must be attached.
The bidder must also confirm that it selects the contracting authority’s standard payment term, that its bid does not contain trade secrets or describes them as required, and that it will not use materials, equipment or goods originating from the Russian Federation or the Republic of Belarus. The contracting authority may request certificates of origin.
