Compliance requirements
The bidder must not be bankrupt or in liquidation, and its business activities must not be suspended. It must not have outstanding tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred or paid within the required deadline. The bidder must not be subject to the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act. The bidder must also confirm that its employees’ average salary during the reference period was at least 70% of the average salary for the same period in the relevant field of the contract, or provide a Tax and Customs Board certificate to that effect. The bidder and the technical consultant advising the beneficiary on the reconstruction of the apartment building must not be related persons. If the checks cannot be made from public registers, the required evidence must be submitted within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered in the Register of Economic Activities for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but it must prove equivalent competence. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated value of the contract, excluding VAT. The bidder must be able to provide, for the construction period, a first-demand guarantee letter or equivalent security in the amount of 5% of the contract value excluding VAT. Within the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value; the equivalent project must involve the construction, extension or full reconstruction of a building as the main contractor and include at least load-bearing structures and external envelope works, heat-recovery ventilation, and heating system construction or reconstruction. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a competent person for electrical works; for each role, the required professional qualification or equivalent proof of competence must be provided. If the bid is a joint bid, a power of attorney for the joint bidders must be included, and the bid price forms must be completed and the bid’s compliance with the tender documents confirmed.
