Compliance requirements

The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, or if its business activity has been suspended. The bidder is also excluded if it has tax debt or social security contribution debt, unless the debt has been deferred or paid. In addition, none of the grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act may apply, and the bidder and the technical consultant advising the apartment building reconstruction for the beneficiary must not be related persons. If the absence of grounds cannot be checked in public registers, the relevant evidence must be submitted.

Qualification criteria and exclusion grounds

The bidder must be registered under the construction activity category with the activity types of general construction, indoor climate systems, and building-internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction and installation of electrical installations; the registration requirement does not apply to a foreign bidder, but equivalent competence must be proven. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The bidder must be able to provide, by the contract signing date at the latest, a first-demand guarantee letter or equivalent security for 5% of the construction contract value excluding VAT, and if necessary within 10 calendar days after signing the contract. As prior experience, the bidder must have carried out at least one equivalent construction project within the last 60 months, with a value of at least half of the estimated contract value; the equivalent project must involve the construction, extension or full reconstruction of a building as the main contractor and must include at least load-bearing and external envelope works, heat-recovery ventilation, and construction or reconstruction of the heating system. The tender must include details of the previous project and proof by a use notice/use permit number or a handover-acceptance certificate. The team must include a project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and, for electrical works, a competent person; the required professional qualifications or equivalent competence must be provided. The tender must be submitted according to the required price structure, and in a joint tender a power of attorney must be included. Conditional tenders are not allowed.
