Compliance requirements
The bidder must confirm that neither it nor any entity whose resources it relies on for qualification has any exclusion grounds under § 95(1) of the Public Procurement Act. If the answer is no, the bidder must describe which exclusion grounds apply. In addition, entities whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate; the same applies to any entity whose qualifications the bidder relies on.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last two completed financial years must have been at least EUR 100,000; assuming the financial year matches the calendar year, these are 2024 and 2025. Within the 60 months before publication of the contract notice, the bidder must have properly performed at least one similar construction contract, acting as main contractor or subcontractor, and the works must have included door installation and either the construction of a new electrical system for a building or the reconstruction of an existing one. The bidder must submit Form 1 with contract details and, upon request by the contracting authority, a confirmation letter from the client. For the construction works, the bidder must involve a project manager who holds either a level 6 construction engineer certificate in building construction and construction management, or a level 6 construction manager certificate with the full specialisation in general construction; basic qualifications and a certificate only in construction management are not considered equivalent. If the certificate was issued in Estonia, the contracting authority will check it in the public professional register, so no document needs to be submitted separately. If the certificate was issued outside Estonia, the bidder must submit the certificate document and a document from the competent Estonian authority confirming equivalence to the required qualification. The bidder must also submit Form 4 for all specialists involved. If the tender is submitted jointly, Form 8 with the power of attorney and joint and several liability confirmation must be provided. The offer must comply with all tender document requirements and, where necessary, include an explanation of equivalence and supporting evidence. Form 2, Form 3, and the declaration of participation in the public procurement, together with the list of documents protected as trade secrets if required, must also be submitted.
