Compliance requirements
The tender documents include the standard exclusion grounds for criminal organisation participation, corruption and other mandatory grounds under the ESPD. The bidder must answer the exclusion questions, and if an exclusion ground applies, may provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full list of exclusion grounds; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the tender price using the form “Technical description and price table”. The tender must be submitted or digitally signed by a person whose representation right is visible in the register; if not, a power of attorney must be attached. In a joint tender, a joint bidders’ power of attorney and confirmation must be submitted, and the ESPD must be provided for all joint bidders. The bidder must have inspected the building before submitting the tender, or confirm that all risks from not inspecting it remain with the bidder. A bidder registered in Estonia must have a business activity notice in the Commercial Register for the activity “Construction” with the sub-activity “General construction”; a bidder registered abroad must have an equivalent registration in its country of establishment, together with proof and a description of the registration. The bidder must confirm that the tender complies with the tender documents, that the work will be carried out for the agreed price, and that there is no competition-distorting conflict of interest. The bidder must also confirm that it is not a legal entity established in Russia and that more than 50% of the ownership does not directly or indirectly belong to citizens or residents of the Russian Federation, or to companies or other entities established in Russia. The machine-readable notice did not include more precise qualification or compliance requirements; these must be checked in the official tender documents.
