Compliance requirements
The machine-readable notice includes the standard exclusion grounds for criminal organisation participation and corruption. If such a ground exists, the bidder may provide evidence of self-cleaning, if allowed by the procurement rules or the tender documents. The notice also states that the bidder must confirm that no subcontractors or suppliers accounting for more than 10% of the contract value are Russian citizens, residents, or entities established in the Russian Federation, or entities more than 50% owned by them, or acting on their instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. If the exclusion grounds or the exact confirmations need to be checked in detail, they must be verified in the official tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice includes a technical and professional capacity requirement: the bidder must have sales experience for the products offered in this tender. For the last 3 years before publication of the contract notice, the bidder must have sold each offered product in at least 1/3 of the quantity planned in Annex 1 for the framework agreement period. The bidder must submit a list of properly completed sales contracts or transactions, showing the lot, the exact product name, contract dates, value, counterparties, and the number of products sold under each contract. The bidder must also have a product representative working for the company or otherwise engaged on a contractual basis, who has been trained by the manufacturer or has completed training for the products covered by the tender. The bidder must confirm the representative’s name in the tender passport and, if requested, provide copies of training certificates or the manufacturer’s written confirmation. The bidder must have the right to sell the offered products in Estonia and must provide a document proving this right, or a copy of the manufacturer’s authorization; if there is sub-authorization, the related documents must also be provided. The bidder must submit the technical specification in Annex 1 with unit prices and the total price for the lot, and the offered products must cover all names required in the lot.
