Compliance requirements
The contracting authority will exclude a bidder if any exclusion ground under § 95(1) of the Public Procurement Act applies. The bidder must confirm that neither the bidder nor the persons with representation, decision-making or control rights have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, human trafficking or other listed offences. The bidder must also have no outstanding national tax, fee or environmental charge debt and must not be in conflict with the conclusion of the contract due to sanctions. If the tender is submitted together with a foreign company or as a joint tender, documents confirming the absence of exclusion grounds for those persons must also be provided if necessary.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. As compliance requirements, the bidder must confirm that it has reviewed the subject matter of the procurement and the tender notice/documents, understands all circumstances that could affect any aspect or the price of the tender, has found no inaccuracies or omissions in the tender documents that would prevent pricing the tender with sufficient accuracy, and has the intellectual property and personal data processing rights needed to prepare the tender and perform the contract. If the tender is submitted by someone other than the bidder’s legal representative, a power of attorney must be provided. For a foreign company, an extract from the commercial register of the country of establishment or another document proving the right to represent the company must be submitted. In a joint tender, a joint bidders’ power of attorney and confirmation must be provided. The bidder must submit a document issued by the manufacturer or the manufacturer’s authorised representative proving the right to sell, supply and provide the Snowflake Cloud Data Platform Software License, Product Support and Maintenance Services to a state-owned company in the Republic of Estonia. The bidder must confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned regions. The bidder must also confirm that the tender complies with the requirements of the tender documents and, where necessary, that equivalence has been explained and supporting evidence has been attached.
