Compliance requirements

The bidder must not be subject to the mandatory exclusion grounds: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences related to illegal employment of foreign nationals or breaches of foreign workers’ employment conditions; illegal child labour or human trafficking; tax, duty or environmental charge arrears, or social security contribution arrears; and sanctions that would prevent the contract from being awarded. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must have at least one designer who, during the 36 months preceding the start of the procurement, has delivered to the client at least 5 construction projects submitted on time and accepted without significant technical defects. In connection with those projects, the land use for the designed utility network must have been regularised on at least two different cadastral units. The bidder must submit a properly completed Form 2, ‘Designer references’. In addition, all unit price fields in the price table must be completed; partial or incorrect completion may render the bid non-compliant. The bid must comply with the procurement documents and, where necessary, evidence explaining equivalence must be attached. If the bid is a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The bidder must provide the names of the contract signatory(ies) and the contact person for contract performance, confirm the standard payment term option, use the EPP portal for invoicing, and state whether subcontractors are used for personal data processing.
