Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or for illegal use of child labour or human trafficking. Exclusion also applies where the bidder has tax, fee or environmental charge arrears, or arrears of taxes or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has submitted false information about qualification or failed to provide required information or documents. Companies whose place of establishment or residence is in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment and goods used in the works may not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, of which at least one must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s details, and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or its own databases. In addition, before bid opening the bidder must have in the EPP system a person with switching authorisations, a person responsible for the work operation, and an electrical works manager with valid A-competence or at least level 6 qualification under the Vocational Qualifications Act, with the relevant proof available at the time of bid submission. The bid must also include the price table and the details of the signatory and contact person; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must comply with the tender documents and conditional bids are not allowed.
