Compliance requirements
The bidder and its management bodies must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm payment of taxes and social security contributions and, where required, provide electronic evidence or database references. The exact exclusion grounds and any exceptions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be the manufacturer’s official representative and provide the manufacturer’s confirmation of representation and sales rights. The tender must comply with the technical specification, and the bidder must complete the required fields in Annex 1 and Annex 2 and submit technical documentation, including data sheets and user manuals. The Estonian user manual for the offered device must be submitted no later than handover of the device. The bidder’s team must include at least one manufacturer-trained medical technology specialist from handover until the end of the contract, with the right to perform maintenance, repairs and user training; the specialist’s name and a certificate, diploma or other confirmation of training must be provided. In addition, a 7-year preventive maintenance plan must be submitted, showing the maintenance frequency, list of tasks and duration of one maintenance visit. The tender must be unconditional, comply with all procurement documents and, where necessary, include evidence of equivalence.
