Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or another terrorism-related offence, money laundering or terrorist financing; conviction for enabling illegal work in Estonia or for violating wage requirements for foreign nationals; conviction for illegal use of child labour or human trafficking; and tax, environmental charge, or social security contribution arrears. The bidder must also confirm that none of the voluntary exclusion grounds apply: serious or repeated breach of a previous public contract leading to termination, withdrawal, price reduction, compensation of damages or payment of a contractual penalty, and submission of false information about qualification requirements or failure to provide requested documents.
Qualification criteria and exclusion grounds
The bidder must have at least three properly performed contracts for similar electrical construction works completed during the 60 months before the start of the procurement, and at least one of them must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details, and, in public procurement cases, the reference numbers; the contracting authority may also request evidence of proper performance. The bid must include a price table in the required format, and all unit price fields must be completed. The team must include a person with switching authorisations who has been entered into Elektrilevi’s partner portal before the opening of tenders; for low-voltage works, at least low-voltage switching authorisations are required, and in other cases both low- and medium-voltage switching authorisations are required. There must also be a person responsible for work operations who has been entered into the Elektrilevi partner portal before the bid submission deadline. In addition, the team must include a lead electrical works person with valid A-competence or at least level 6 qualification under the Vocational Education Act, who has the relevant certificate at the time of submission and has been added to the Elektrilevi partner portal before the deadline. The bid must include the names and contact details of the signatory or signatories and the contact person, and a power of attorney must be attached if needed. If the bid is joint, a joint bidders’ power of attorney must be included. The bid must comply with all tender document requirements, and conditional bids are not allowed.
