Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or paying less than the statutory wage; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax/social security contribution arrears under the law of the bidder’s country of establishment; and situations where awarding the contract would breach an international sanction or a sanction of the Government of Estonia. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least one contract for works similar to the subject of the tender (rail track alignment and tamping works) within the last 60 months, in a volume comparable to the subject of the tender. A list of at least one reference contract must be submitted, showing the client, contact person, email address and phone number, the name and short description of the work, and the volume and duration of the works. The bidder’s works manager must hold a qualification corresponding to the occupational standard Rail Mechanic, at least level 4, and the special rolling stock operator must hold the qualification Special Rolling Stock Operator, at least level 4. Copies of the qualification certificates must be submitted with the tender. The bidder must also provide a list of the equipment to be used, with technical data and a description, and complete the tender price form.
