Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the ESPD. The machine-readable notice includes exclusion grounds for participation in a criminal organisation, corruption and fraud. For these grounds, the bidder or its management, administrative or supervisory body members, or persons authorised to represent or control the bidder must not have a final conviction within the last 5 years, unless the disqualification period has expired. If an exclusion ground exists, the bidder may, where allowed, provide evidence of self-cleaning. The notice also refers to electronic availability of evidence where applicable. The exact exclusion grounds and any additional confirmations must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have a last completed financial year net turnover from landscaping work of at least EUR 40,000. The bidder must submit in the ESPD the turnover data for that financial year and, if requested, the annual report or an extract from it if the data are not available from a public register.
For technical and professional capacity, the bidder must submit a list of landscaping maintenance contracts, including gardening works, completed during the 24 months before the start of the procurement. The list must show at least 2 completed contracts and include the contract value, dates and the other contracting party’s contact details (including phone and email) and, for public contracts, the reference numbers.
For the contract performance/compliance requirements, the bidder must confirm that it has visited the places where the contract will be performed, that the tender complies with the tender documents, that it is not a conditional tender, and that the tender is submitted electronically in the required format. The bidder must also provide a site supervisor for the gardening works. The site supervisor must hold at least gardener level 4 or equivalent, or landscape builder level 4 or equivalent, and a CV showing the qualification and work experience must be submitted. If the supervisor is replaced, the substitute must be equally qualified. If the bidder uses a joint tender, a signed power of attorney from all joint bidders must be attached. If subcontractors are used, information and confirmations for the known subcontractors must be provided.
