Compliance requirements
The contracting authority will exclude a bidder if a mandatory exclusion ground applies to the bidder or to a person representing, managing or controlling the bidder, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to employing a foreign national staying in the country without legal basis or violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; offences related to illegal use of child labour or human trafficking; or tax, environmental, social security or similar payment arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract or for providing false information or failing to submit required information or additional documents. The machine-readable notice also includes confirmations that the bidder’s place of establishment is not in Russia or Belarus and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus; origin certificates may be requested.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them worth at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts with the performance period, details of the other contracting party (including the client representative’s contact details, phone number and email address) and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without major effort. The bidder must also confirm compliance with the tender documents, submit the price table in the required form, and confirm that it has the required switching-authorised employee, the person responsible for the work operation, a person with valid A-competence and/or at least level 6 qualification for managing electrical works, representation details for contract signing, and acceptance of the standard payment term or the factoring programme term. The notice also requires confirmations regarding business secrecy and the Russia/Belarus restrictions.
