Compliance requirements
A bidder or applicant is excluded if the bidder or its authorised representatives fall under the exclusion grounds in § 95(1) points 1–5 of the Public Procurement Act: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment of a foreign national or violating wage requirements; unlawful use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax arrears in the country of establishment; or a breach of an international sanction or a sanction imposed by the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder and/or its subcontractor must have at least one properly performed electrical or automation works contract of similar complexity and scope to the subject of the tender, completed within the 60 months preceding the start of the procurement. A list of at least one such contract must be submitted, including its value, dates and the other contracting parties.
For design works, there must be at least one designer responsible for the works who holds at least level 7 professional qualification as a certified electrical or automation engineer, or equivalent or better B-class competence for design. Copies of documents proving qualification and competence must be submitted; a foreign bidder must submit the corresponding documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
For managing the works, there must be at least one person managing electrical and automation works who holds at least level 7 professional qualification as a certified electrical or automation engineer and/or a B-class competence certificate, equivalent or better. Copies of documents proving the qualification and competence of this person must also be submitted.
The IT specialist must have completed at least the TIA Portal programming course for configuring, adding changes to and entering data into Siemens PLC S7-1200 systems, and must have completed at least one project finished within the last five years in the WinCC Unified software environment. A copy of the relevant certificate must be submitted.
The bid must comply with all conditions set out in the procurement documents, and conditional bids are not allowed. The bidder must also confirm that the offered goods are not subject to an international sanction and do not originate from sanctioned areas.
