Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) points 1–3 and 5 of the Public Procurement Act apply to it, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been opened against it, and its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee or environmental charge arrears, or tax or social security contribution arrears, under the law of its country of establishment. The bidder must confirm that its average employee remuneration during the reference period was above 70% of the average remuneration in the same period in the relevant field for the contract. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement procedure. The bidder must provide a Tax and Customs Board extract, or an equivalent certificate from a competent authority in its home country for a foreign bidder. In a joint tender, the proof must be submitted for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or building-related water supply or sewerage systems. This registration requirement does not apply to foreign bidders, who may prove equivalent competence instead. For electrical works, the bidder must be registered for electrical works covering construction and installation of electrical installations; foreign bidders may again prove equivalent competence. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The bidder must be able, by the contract date or within 10 calendar days after signing, to provide a performance guarantee equal to 5% of the contract value, either as a bank/financial institution guarantee or by depositing the corresponding amount to the beneficiary’s bank account or a notary account, with the beneficiary as the entitled party throughout the construction period. The bidder must have completed at least 1 equivalent construction project during the 60 months before the start of the procurement procedure, as main contractor, with a value of at least half of the estimated contract value excluding VAT. The equivalent project must involve building erection, extension and/or full-building reconstruction and must include at least structural and external envelope works, heat-recovery ventilation works, and heating system works. The bidder must provide the project name, timing, value, whether it was erection/extension/full reconstruction as main contractor, and whether it included the required works, together with proof such as a handover-acceptance act or a reference to the building register use notice or occupancy permit number. The team must include a project manager with at least level 6 construction engineer or construction manager qualification, an object/site manager with at least level 5 construction work manager qualification, a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer or equivalent construction manager qualification, a water supply and sewerage systems specialist with at least level 6 qualification or equivalent, and a person involved in electrical works with at least a B-class competence certificate or level 6 electrical engineer qualification. The bidder must provide the names and certificate or qualification numbers for these persons. If team members are not the bidder’s employees, written consent for their involvement must be submitted. The bidder must also confirm compliance with the tender documents and submit the required tender form, joint tender power of attorney if applicable, representation authorisation if applicable, a brief statement of business secrets if any, and equivalence evidence where relevant. The machine-readable notice did not include precise requirements for item 11 and the remaining part of the team/compliance section; these must be checked in the official tender documents.
