Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy, liquidation, suspended business activity, or tax and social security debt. The bidder must also confirm that its average salary during the reference period was more than 70% of the average salary in the same sector for the relevant period, and provide a Tax and Customs Board extract or an equivalent certificate for a foreign bidder. In a joint bid, the proof must be submitted for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. The exact exclusion conditions and the verification procedure must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered under the construction activity category with the sub-activities of general building construction, indoor climate systems, and building-internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. A foreign bidder may provide an equivalent certificate instead of registration.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover cannot be aggregated to meet this requirement; it is sufficient if at least one joint bidder meets it on its own.
The bidder must provide details of at least one equivalent construction project carried out within the last 60 months. The equivalent work must have been the construction, extension or full reconstruction of a building as the main contractor and must have included at least the construction or reconstruction of the building’s load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. To prove the work, the bidder must provide the number of the occupancy notice or building permit in the building register, or a copy of the handover-acceptance certificate signed by the client and contractor.
The team must include a project manager with at least Level 6 professional qualification as a construction engineer specialising in building construction, or Level 6 qualification as a construction manager specialising in general building construction. An object/site manager with at least Level 5 qualification as a construction foreman specialising in general construction works is also required. In addition, the team must include a ventilation and heating systems specialist, a water supply and sewerage systems specialist, and, for electrical works, a qualified person; for each role, the bidder must provide the person’s name and the number of the professional or competence certificate. A foreign bidder may submit evidence of equivalent competence.
The bidder must also accept the condition that by the contract signing date at the latest, or within 10 calendar days after signing, it must be able to provide a performance security equal to 5% of the contract value. The bid must be submitted on the tender form in the procurement documents, and the bidder must confirm compliance with the tender documents, representation rights, a power of attorney in the case of a joint bid, and, where relevant, the marking of trade secrets.
