The bidder must confirm that neither it nor persons with management or representation rights have been convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, where permitted. The ESPD also includes sanctions-related confirmations: the bidder must confirm that it does not use subcontractors or suppliers linked to Russia for more than 10% of the contract value, and that the goods offered are not subject to international sanctions and do not originate from sanctioned areas. The bidder must also confirm that it is not itself, and does not rely on the resources of, an undertaking established in the Russian Federation or the Republic of Belarus. In a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must indicate any business secrets, and must confirm compliance with the tender and equivalence requirements.

The bidder’s total annual turnover from all business activities in each of the last three completed financial years must be at least EUR 50,000 per year. The bidder must confirm this in the ESPD and, if the turnover data are not available from a public register, provide the financial statements or extracts for the last three financial years upon the contracting authority’s request. The tender price must be submitted using Annex 3, in euros and excluding VAT, with two decimal places. All required fields must be completed and conditional tenders are not allowed. The bidder must confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary, and that supporting evidence has been attached. If subcontractors or suppliers are used, the sanctions restrictions must be observed. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the procurement documents.
