Compliance requirements
The bidder must confirm that neither it nor persons with management or representation rights have been convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, where permitted. The ESPD also includes sanctions-related confirmations: the bidder must confirm that it does not use subcontractors or suppliers linked to Russia for more than 10% of the contract value, and that the goods offered are not subject to international sanctions and do not originate from sanctioned areas. The bidder must also confirm that it is not itself, and does not rely on the resources of, an undertaking established in the Russian Federation or the Republic of Belarus. In a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must indicate any business secrets, and must confirm compliance with the tender and equivalence requirements.
