Compliance requirements
The mandatory exclusion grounds cover convictions of the bidder or its management/supervisory representatives for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; convictions for enabling illegal work for a foreign national staying without legal basis or for violating the conditions of employment of a foreign national in Estonia, including payment below the statutory wage rate; convictions for illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or tax or social security contribution arrears under the laws of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract, or if the bidder has provided false information about qualification or failed to submit required additional documents. The machine-readable notice did not include any further precise exclusion requirements; these must be checked in the official tender documents.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party (including the client representative’s contact details, telephone number and email address) and, in the case of public procurements, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without major expense. The bidder must also have a person in charge of electrical works with a valid A-level competence or an equivalent qualification under the Vocational Education Institutions Act, who holds the relevant certificate at the time of submission and has been entered into the EPP environment before the opening of tenders. In addition, the bidder must have a worker with valid switching rights for switching operations in the 0.22–20 kV electrical network and a person designated as responsible for the work operation with valid rights; both must be entered into the EPP environment before the opening of tenders. The tender must comply with the procurement documents, and the tender price must be submitted in the required table with all unit price fields completed. If the right of representation does not arise from the articles of association, a power of attorney must be included. The machine-readable notice did not include any further precise qualification or compliance requirements; these must be checked in the official tender documents.
